Terms of Service - Syber Orange VR Chat World Asset

These Terms of Service (the "Terms") govern your use of the VR Chat world asset titled "Bong System" (the "Asset"), created and copyrighted by Syber Orange ("Syber Orange," "we," "us," or "our"). By accessing, downloading, or using the Asset, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Asset.

1. Grant of License

1.1. Limited, Non-Transferable License: Syber Orange grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Asset solely for your personal, non-commercial enjoyment within the VR Chat platform.

1.2. No Resale or Redistribution: You may not sell, rent, lease, lend, sublicense, modify, adapt, reproduce, distribute, publicly display, publicly perform, or otherwise exploit the Asset, in whole or in part, for any commercial purpose.

2. Prohibited Conduct

2.1. No Sharing or Distribution: You are expressly prohibited from sharing, transferring, distributing, or otherwise making the Asset available to any third party, including friends, community members, or any other individuals, regardless of whether compensation is exchanged. This includes, but is not limited to, sharing the Asset file, providing access to the Asset in a manner that bypasses VR Chat's intended sharing mechanisms, or allowing others to download or copy the Asset from your account or any other source.

2.2. No Derivative Works: You may not create derivative works based on the Asset, nor may you reverse engineer, decompile, or disassemble the Asset.

2.3. No Commercial Use: The Asset is provided for personal, non-commercial use only. Any commercial use, including but not limited to, using the Asset for paid events, advertising, or promotional activities, is strictly prohibited without the express prior written consent of Syber Orange.

2.4. Compliance with VR Chat Terms: You agree to use the Asset in compliance with all applicable terms and policies of the VR Chat platform.

3. Intellectual Property and Copyright

3.1. Ownership: The Asset, including all intellectual property rights therein (including but not limited to copyrights, trademarks, and trade secrets), is and shall remain the sole and exclusive property of Syber Orange. All rights not expressly granted to you in these Terms are reserved by Syber Orange.

3.2. Copyright Protection: The Asset is protected by copyright laws and international treaties. Unauthorized reproduction, distribution, or public display of the Asset, or any portion thereof, is strictly prohibited and may result in severe civil and criminal penalties.

3.3. No Infringement: You acknowledge and agree that your use of the Asset does not grant you any ownership rights or intellectual property interests in the Asset. You will not challenge Syber Orange's ownership or rights in the Asset.

4. Breach of Terms and Legal Action

4.1. Consequences of Breach: Any breach of these Terms, particularly sections 2 (Prohibited Conduct) and 3 (Intellectual Property and Copyright), will be considered a material breach and may result in the immediate termination of your license to use the Asset.

4.2. Legal Remedies: In the event of a breach of these Terms, Syber Orange reserves the right to pursue any and all available legal remedies, including but not limited to, injunctive relief, monetary damages, and attorney's fees, to the fullest extent permitted by law. You acknowledge that unauthorized sharing or distribution of the Asset may cause irreparable harm to Syber Orange.

5. Disclaimer of Warranties

THE ASSET IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL SYBER ORANGE BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE ASSET OR THE USE OR OTHER DEALINGS IN THE ASSET.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SYBER ORANGE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE ASSET; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE ASSET; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

7. General Provisions
